Today, the topic of dismissing cadets from a military educational institution is still poorly developed from a legal standpoint. It raises many questions for both university administrators and cadets, as evidenced by the editorial mail. Readers are interested in the regulations governing dismissals, the legal status of cadets at different levels, and the possibility of being denied a subsequent dismissal as a disciplinary measure.
When considering the issue of dismissing cadets studying at military educational institutions, military personnel can be divided into three groups. These include cadets who have not signed a contract for military service and are under the age of 18, as well as first-year students; cadets who have signed a contract for military service, and contract soldiers who have enrolled in a university.
The last group is quite simple. Contract servicemen already have a certain status and can fully use the rights granted to them by the Internal Service Regulations of the Armed Forces of the Russian Federation, approved by the Decree of the President of the Russian Federation dated December 14, 1993, and the Federal Law "On the Status of Military Personnel" No. 76-FZ dated May 27, 1998.
The issue of cadets who have not yet signed a contract for military service is also easily resolved. They are legally equivalent to conscripted military personnel, and their dismissal is strictly regulated by the Internal Service Regulations of the Armed Forces of the Russian Federation. In particular, Article 248 of the Regulations states that the dismissal of first-year cadets from a military educational institution is carried out in accordance with the procedures established for conscripted soldiers and sergeants.

The military oath is the reason for military personnel leaving the university. You must ask your immediate superior for permission to leave.
A conscripted serviceman, if he is not subject to a disciplinary penalty - "deprivation of another dismissal" - may be dismissed from the university's location once a week. On Saturdays and pre-holidays, dismissal is allowed up to 24 hours, and on Sundays and public holidays - until the evening verification. On weekdays, with the permission of the head of the school, a cadet can receive a dismissal for a valid reason after training sessions until lights out or until the next morning, but not later than 2 hours before the start of classes.
The dismissal is carried out in the order of priority. It is carried out by the squad leaders, and in the platoons by the deputy platoon leaders. In addition, the deputy platoon leaders submit lists of dismissals from the university's premises to the company sergeant major for reporting to the company commander. At the same time, more than 30 percent of the personnel cannot be dismissed from the unit.
Legal difficulties arise when it comes to dismissing cadets in subsequent courses. Unfortunately, a second-year student who has signed a contract for military service is not yet legally considered a full-fledged contract holder. On the one hand, this gives them an advantage: according to the Disciplinary Regulations, military personnel serving under a contract as soldiers, sergeants, and warrant officers cannot be subjected to disciplinary actions such as being denied a regular leave from the military unit. However, the procedure for dismissing second-year cadets is established by the head of the military educational institution of professional education. Cadets from the third year onwards can feel more like full-fledged contract soldiers. For example, the "Dismissal from the Regiment's Location" section of the Internal Service Regulations of the Armed Forces of the Russian Federation allows third-year and subsequent cadets to stay outside the military educational institution of professional education after classes and mandatory independent study hours for up to 24 hours. Family cadets - before the start of the next school day.
However, it should be noted that Article 248 of the Internal Service Regulations somewhat restricts this right. It stipulates that these cadets are not allowed to leave the military educational institution after the hour specified in the service time regulations.
